"Making your own ToS is not allowed and will be ignored."
Let's assume I was selling some cracking tool and put the following into my TOS: "you are not allowed to resell/share this program". However, this rule renders my TOS null. Does that mean buyers are allowed to resell/share the program?
Another scenario I can think of is web hosting. Let's say the TOS says "posting child porn is not allowed and will result in your account being banned". But due to this rule, buyers can ignore the TOS without the seller taking any action.
I've seen many buyers break TOS and blame this rule for it. I don't think this rule should exist anymore because it's pointless and causes many problems for sellers.
