So this user opened chargeback ,what he will lose anyways , but its totaly againts my TOS,as i would refund him if the SE would be failed 3 times,but only 1 try failed.Can be seen here http://prntscr.com/lcffv7

I opened a chargeback due to being ignored on numerous occasions, I got promised CONFIRMATION within 24 - 72 hours, I did not get that at which point he said it will be on Monday, monday arrives and he then says it will be on tuesday (referring to the confirmation) I did not recieve it on any of the three occassions he said I would, full proof can be found here :

Notice he said once I lose the chargeback I'm fucked and that I am the one scamming him? How does that make any sense, how can I scam MY OWN money back? I did not get the confirmation on ANY of the 3 occassions he said I would, so if getting my money back at this point is scamming I'm very confused because I am yet to recieve anything.
 

Note his forum thread itself states "24 hour confirmations"

Either provide the refund or the product, if you are not certain you will get it done in a time frame, then why do you give one?

Well Paypal has already resolved it in his favor, thank you for the information because that shows that if he meant reviewed, it already has been, meaning he is able to refund me now.
