Since i am not responsibile that the account got recovered i told the OP that i will reban with discount. But he decided to do a scam report, please check my TOS.

Using your own TOS is not allowed unless you discuss them with the customer in the chat prior to the transaction taking place. If you mentioned the TOS to him on the chat and he accepted them, then they are valid. You can't link TOS from a thread and say he should have read them. They should have been clarified on your chat. Our rules state clearly that you are not allowed to create custom TOS. 

 

If you did not discuss the TOS before he purchased, on the chat, he should receive a refund or a new ban.

 

You should also remove the line in your terms that states it almost never happens. That's a lie and it makes your TOS abusive. I have seen plenty of transactions involving instagram account bans and 90% of them ended up getting unbanned hours after the ban. You are being misleading and at the very least should disclose the truth to the customer.

Yes, before buying the costumer asked if they are any chances of unban and I said what my tos said, he accepted them, but he cleared the chat, he can confirm

I do not recall such a conversation, I did ask if the account could be unbanned and the seller said no, very difficult to unban.
