Additional Information:

 

After attempting to book for a few days, I had a family emergency come up that I was worried may impact my ability to check into a hotel, so I informed Cooper that I would like to cancel as soon as possible to which he told me the process was already in progress and that I could not cancel anymore unless the hotel refused the booking.

 

He then continued to request spare hotels, for from me just in case the original was not going to work. I didn’t provide any spare hotels at this point because I did not want the booking anymore and didn’t want him to continue trying to book a room for me that I wouldn’t be able to use.

 

After I got confirmation that I would not be able to attend the hotel at any point during the booking due to my emergency, so I called the hotel (12:58AM) after informing Cooper of this. The receptionist at the hotel told me that they see the booking but that it had been canceled prior to midnight, and that there would be no late cancel fee. I relayed this info to Cooper and he questioned if it was cancelled because of me, I said no. He read my message and did not reply.

 

4 hours later he sends me what appears to be a booking confirmation in a copy and paste format, no official booking email or screenshot, anything. I then called the hotel a second time and the receptionist that I speak to says she was actually just about to email me and wanted to make sure that there wasn’t a reason to reinstate the booking so as of this time it is still canceled. I said no and ended the conversation.

 

I then began to ask Cooper if he could refund me as the hotel says the booking is not active and I don’t want the booking anymore anyways. He is refusing to do so, and tells me that I can’t be refunded because the process was started and because it’s a family emergency but nothing about the fact that there is not an active reservation and as far as I can tell, there never seems to have been one as I never got a legitimate confirmation from Cooper. He is now also threatening to leave bad karma for me, as well as request a charge from me if I file a scam report because he believes I lied about calling the hotel and that they told me the stay was cancelled and that I am trying to “fuck him”.

 

It’s my opinion that there wasn’t a booking at any time, and even though I gave ample time to Cooper that I was not going to be able to use the booking that he continued to try and book even after the hotels initial refusal and not because the process was started even though there were multiple times throughout the process when he couldn’t continue, unless I had sent other hotels, so that he could keep the money I sent for the booking anyways and that is why he did not respond to me when I initially called the hotel and that they informed me the booking was canceled and so I am requesting a refund of the fee I paid to him.

 

I'll also include a screenshot of Coopers TOS being edited at 8:24 this morning, whether or not a change was made to attempt to keep my fee, I don't know.

His terms are clear in the sense that once he starts the booking process, you cannot just 'cancel' the transaction arbitrarily. Your personal situation that made you want to cancel the service, no matter what it was, does not mean you can avoid the terms of his service. 

I do agree that his term is abusive in some ways, and that he got you the booking after you told him you could not go. 

 

@DBcoooper He should receive (after you cancel the booking) a refund of 90% of the amount he paid you. The 10% you are free to keep as a cancellation fee. This should also be noted in your terms. When a customer wishes to cancel, with no active booking or after a specific number of tries that did not go through, they are free to cancel the transaction by paying this cancellation fee. You are free to change this number for future instances if you feel like you deserve more % for trying to book the hotels for the customers. Not in this instance. 

 

 

No service is allowed to arbitrarily decide to force the customer to continue using the service if the service has to be started again, or if the service is not in progress. In this case, the customer was explicit and clear when he said he could not go due to personal reasons and you could have stopped the service and offered him to pay a cancellation fee. But you didn't and instead sent him a new booking you knew he could not accept. This is not acceptable behavior. The new booking was clearly not done by the time he told you he wanted to cancel the transaction. 

 

Terms such as ''You can't cancel once the process is started'' are abusive because they don't give any sort of assurance to the customer that the process will ever be completed. You could say that and take weeks to complete the booking. This is just not acceptable. Your term stating that you won't be responsible if he is unable to go to the booking, does not relate to this situation at all. The customer told you that he could not go before you made the booking and at that point, you could have cancelled the transaction.

After talking to @DBcoooper he has provided evidence showing that the booking was not just cancelled on its own as you said and that you were the one who called, and reported ''fraudulent activity'' and asked them to cancel your booking. This is not acceptable. You paid them for a service and they have no reason to see their work ruined no matter what your personal circumstances could have been. You told them explicitly that you would accept the booking if they managed to get it done on that specific hotel. They did and you called the hotel to cancel the booking. This results in you forfeiting the payment and not being able to make a claim for any % as they completed the work you requested. 

It's really unfortunate that you were not able to enjoy the booking. However you had no right to cancel the booking or to report ''fraudulent activity'' on it just to get him to refund you. This was checked and confirmed by the person from the front desk that you spoke with.
